# IRS Launches ICRS: A Correction Program for IRAs

## IRS releases Rev. Proc. 2026-33, introducing the IRA Compliance Resolution System (ICRS) to formalize procedures for making voluntary corrections to IRA errors.

On October 22, 2026, the IRS released **[Revenue Procedure (Rev. Proc.) 2026-33](https://www.irs.gov/pub/irs-drop/rp-26-33.pdf)**, which introduces the IRA Compliance Resolution System (ICRS). The ICRS formalizes procedures for making voluntary corrections to IRA errors. This Rev. Proc. provides guidance that follows the principles of the longstanding Employee Plans Compliance Resolution System (EPCRS), but it does not contain a self-correction program at this time. Specifically, the ICRS requires applicants to the program to submit detailed information about the nature of the IRA failure and the requested relief. The Rev. Proc. outlines safe harbor correction methods but also permits other reasonable corrections. Four specific failures are identified as eligible for correction under ICRS.

1. **RMD failure** – A Service Provider follows established procedures, but fails to pay the full RMD through an oversight or mistake in applying them
2. **IRA establishment failure** – The wrong kind of IRA (e.g., Roth instead of Traditional) or a non-IRA account is established
3. **Nonspouse beneficiary distribution or rollover failure** – A nonspouse beneficiary, relying on erroneous Service Provider advice, takes a distribution from an Inherited IRA, including the decedent’s IRA, (or has the amount moved to an account that is not an Inherited IRA) instead of completing an Inherited IRA-to-Inherited IRA transfer
4. **60-day rollover failure** – A distribution from an IRA or employer plan is not rolled over within 60 days due to events beyond the IRA owner’s or participant’s reasonable control

**NOTE*:***Both the RMD failure and the IRA establishment failure must result from a Service Provider error that occurred despite established, routinely followed procedures. A submission to correct an IRA establishment failure must be filed no later than December 31 of the year following the year the incorrect account was established.

Rev. Proc. 2026-33 prescribes corrections for each of these failures. Failures that involve SEP and SIMPLE IRAs are covered, but SEP “arrangements” and SIMPLE “plans”—that is, the employer-sponsored plan and not the account established for each eligible employee—must still use EPCRS and not the new ICRS.

The IRS invites comments on ways to improve this IRA corrections program, with comments due by January 20, 2027. The IRA Compliance Resolution System is scheduled to become effective on May 1, 2027.
